Terms of Service

Version 2026-10-19 · EPR EU Rep · Razvan Toma, Calle Fernando Vizcaíno Casas 14, 28023 Madrid, Spain · VAT ES Y4319918A · hello@eprfrancerep.com

1. Who we are and who these terms are for

EPR EU Rep is a trading name of Razvan Toma (Dragos Razvan Toma), a natural person established in Madrid, Spain, VAT ES Y4319918A ("we", "us"). We contract and invoice the services ordered through epreurep.com and our country sites, in particular eprfrancerep.com, eprspainrep.com and epritalyrep.com. These terms apply between us and the company that orders our services ("you", "the client"). Our services are offered only to businesses, not to consumers. By accepting them at checkout you accept them on behalf of your company and confirm that you are authorised to do so.

Where a country site publishes its own terms (for example eprspainrep.com/terms/), those apply to that country's service and prevail over these terms. Representation in Germany is contracted with EPRGermanyRep GbR under its own terms at eprgermanyrep.com/terms/.

2. Our service

We arrange and manage extended producer responsibility (EPR) obligations for producers established outside the country they sell into: scope assessment, registrations, membership of the collection scheme (eco-organisme, SCRAP or similar), identification numbers, annual declarations and, where the national law requires it, authorised representation. National law usually requires the authorised representative to be established in the country concerned, so the written mandate is signed with the person or entity established there. What we do for you in each country is set out in that mandate; if it and these terms differ, the mandate prevails. We do not give legal advice.

Some steps depend on third parties: collection schemes decide on membership, and authorities issue registration and tax numbers. We file what we need to file promptly, but we cannot guarantee how long they take.

3. Fees and renewal

Our fee is the amount shown at checkout for your plan and countries, for the calendar year in which you order. Your service then renews automatically every 1 January for the next calendar year, at the then current fee, and is charged to the payment card you used at checkout. You can cancel the renewal at any time before 1 January by email to hello@eprfrancerep.com; the year already paid is not refunded.

Prices are shown without VAT. VAT is added where the law requires it. Supplies to businesses in another EU member state are invoiced without VAT under the reverse charge (Article 196, Directive 2006/112/EC), provided a valid VAT identification number is given; businesses outside the EU are not charged Spanish VAT.

4. Eco-contributions and other third-party charges

Our fees do not include the charges of third parties, in particular the eco-contributions, tariffs and fees of collection schemes for the products and packaging you place on the market, and the fees for registrations, translations, apostilles, notarial acts or other formalities that the law or a scheme requires, including for earlier periods that have to be made up. We pass these charges on to you at the amount charged to us, with no markup. We are not obliged to advance them.

5. Additional services

Services beyond those included in your plan, such as obligations for periods before our appointment or an additional country or product category, are charged separately as shown at checkout or quoted to you in writing. We start quoted work only after you accept the quote.

6. Payment by card on file

When you pay at checkout, your card is stored by our payment provider, Stripe. You authorise us to charge that card, or any card you later add, for the annual renewal under section 3, the third-party charges under section 4 and the additional services under section 5. Charges other than the annual renewal are made only from your client portal or a payment link we send you, after the amount and what it is for have been shown to you and you have confirmed it. Every charge is followed by an invoice by email. If your bank asks for additional authentication, you complete it on Stripe's payment page. If a charge fails, the amount remains due and we may send you a payment link or an invoice instead.

7. Your obligations

You give us complete and correct information and documents on time, in particular what you sell, in which countries, the quantities and materials of your products and packaging per calendar year, and the signed documents the schemes and authorities require. You tell us without delay if this information changes. The declarations we file and the charges we pass on are based on your information.

8. Liability

We are liable for damage caused by intent or gross negligence. Otherwise our liability is limited, as far as the law allows, to the fees you paid for the calendar year concerned. We are not liable for the consequences of incorrect, incomplete or late information from you, for charges or sanctions relating to periods before our appointment, or for the acts and the timing of third parties such as collection schemes and authorities. You indemnify us against third-party claims, outstanding charges, costs and, where the law allows, penalties that result from incorrect, incomplete or late information from you or from a breach of your obligations, unless we are at fault.

9. Term and termination

The service runs for the calendar year paid and renews as set out in section 3. Either side may terminate it in writing (email is enough) with effect from the end of a calendar year. Either side may terminate for serious cause, in particular if fees or third-party charges remain unpaid 14 days after a reminder, if required information is not provided despite a request, or if you insist on incorrect declarations. When the service ends we notify the schemes and authorities that our representation has ended; you are then responsible for appointing a new representative where the law requires one. Obligations that arose while the service ran, in particular declarations for those periods, remain unaffected.

10. Final provisions

Spanish law applies. The courts of Madrid have jurisdiction. If a provision of these terms is invalid, the rest remain valid. We may change these terms for future periods; we will tell you by email at least one month before a change takes effect, and you may terminate before then.
